Declaration of Resistance
At the founding of our nation, our forefathers felt compelled to list the reasons they should resist the laws of their ruler, King George III, and separate from England. That list—the Declaration of Independence—describes King George as an out-of-touch thug—dogmatic, self-centered, unreasonable, and unworthy to rule the colonies—requiring the colonists to rise up and resist. Again the time has come to resist the rule of an unprincipled bigot, an incompetent megalomaniac, and a self-dealing fraud—a businessman well-versed in bankruptcy and tax evasion, a con artist unqualified to lead our nation, a charlatan destined to destroy all of the principles that true Americans cherish. Our new Declaration of Resistance is this: Trump is not our President.
When, in the course of human events, it becomes necessary for American Citizens to resist the election of a President who represents a dangerous threat to the United States, to the powers of the earth, and to American civil liberties—to which the laws of nature entitle them—those citizens should declare the causes that impel them to the resistance.
We hold these truths to be self-evident, that all people are created equal, regardless of gender, race, religion, or sexual orientation, that we have inalienable rights—life, liberty, and the pursuit of happiness—and that our government was instituted to protect these rights. But should this government threaten to destroy its people’s rights, it becomes a citizen’s duty to resist, to protest, and to protect the public’s safety and happiness. People are more disposed to suffer evil than to fight it; but when a clear and present danger threatens to destroy their rights as Americans and as citizens of the world—to reduce them under absolute despotism—it is their right, it is their duty, to throw off such government, and to provide new guards for their future security.
Such is the current condition of these United States of America. The history of President-elect Donald Trump is a history of repeated injuries and injustices, all pointing to his lack of qualifications, experience, integrity, and temperament to be our Commander in Chief. To prove this, let facts be submitted to a candid world.
He has refused to submit his income tax records, as all Presidential nominees have done for the last 45 years.
He has admitted to worming his way through tax law loopholes—not available to the rest of us—to benefit his personal and corporate accounts. Court records show that he “has not paid any income tax since 1978, or maybe a little bit in a couple of years,” and that though he claims to be worth billions of dollars, several times has received “tax rebates.”
He has directed his businesses to file for bankruptcy four times—because those companies had incurred billions of dollars of debt—allowing him to avoid paying the people who plumbed and wired and designed his buildings—a move he calls “smart business.”
He has agreed to pay $25 million to avoid facing fraud charges, for swindling students of his phony university. Over 6000 students of his now defunct Trump University claim that the President-elect of the United States defrauded them of $40 million in course fees through dishonest marketing practices. The case had been in the judicial system already for six-and-a-half years, but Trump argued that as President-elect, he still wouldn't have time to address these charges and tried to delay the court date again until after his inauguration—apparently, once he became President of the United States, he would have more time on his hands. But when the judge denied pushing back the court date of November 28, 2016, Trump agreed to pay the students he scammed, plus "an additional $1 million in penalties to the state of New York for violating state education laws."
He has committed fraud against his own “charitable organization”—The Donald J. Trump Foundation—by using donor money for personal gain. The Attorney General for the State of New York has alleged in a formal complaint that Trump has used donors’ money:
to buy personal items ($20,000 for a 6-foot portrait of himself; $12,000 for Tim Tebow’s football helmet);
to settle lawsuits against himself ($125,000 “donated” to other charities, so his homeowner’s association would waive fines against him for violating their flag-height rule);
to bribe government officials ($25,000 to the campaign of Florida Attorney General Pam Bondi, four days after Bondi announced in 2013 that she would join the New York Attorney General in the investigation against Trump University. Soon after that, Bondi made another announcement: She would NOT investigate Trump University.)
When The Washington Post contacted 420 charities that Trump claimed to have supported with “charitable donations,” they found no proof of Trump donating to any of them.
He has aligned himself with Big Banks, promising to get rid of the Dodd-Frank Wall Street Reform and Consumer Protection Act—which reinstated regulations on banks after the collapse of largely unregulated, too-big-to-fail financial institutions, leading to the Recession that began in 2008—causing economists to sound the alarm for another impending financial crisis.
He has aligned himself with Big Oil, guaranteeing to dismantle environmental regulations, to withdraw from the Paris climate agreement, to give tax cuts to the oil industry, to increase fossil fuel production, to approve the Keystone XL pipeline, and to breach the Treaty of 1851 and allow the completion of Dakota’s Access Pipeline, destroying Native American sacred land and contaminating their water source.
He has threatened the future of our planet by taking steps to dismantle the Environmental Protection Agency, placing Myron Ebell—a notorious opponent of global warming and climate change—in charge of the EPA transition team.
He has thwarted our right to religious freedom under the Constitution of the United States by threatening to require Muslims to register and promising to surveil their mosques; by aligning himself with the Conservative Christian Right, whose Republican representatives have already tried to thread their scriptural doctrine into our secular laws—abortion, birth control, homosexuality—pushing our democratic government toward a theocracy, forcing American citizens to abide by Christian religious belief—directly violating the Constitution of the United States, which guarantees the separation of Church and State.
He has promised to appoint Supreme Court Justices who will interpret laws and render opinions based on Conservative religious belief, which does not represent the principles, the faiths, or the consent of 60% of the American people:
55 percent support Gay marriage;
56 percent support legal abortion;
58 percent support some kind of universal health care;
64 percent are worried about global warming;
59 percent believe that immigration helps the country;
And up to 90 percent support background checks for gun buyers.
Supreme Court justices who are anti-choice and anti-LGBTQ will not represent the will of the people: Laws interpreted against them are discriminatory and will prevent their freedom of choice. One candidate on Trump’s list for Supreme Court Justice, Judge William H. Pryor Jr. posed naked for a gay porn site in 1997, yet later upheld a 2003 Texas law that criminalized gay sex, ruling that “This Court has never recognized a fundamental right to engage in sexual activity outside of monogamous heterosexual marriage, let alone to engage in homosexual sodomy.” Through his Conservative Supreme Court appointments, Donald Trump will support an emerging, unlawful theocratic government and will enforce the policing of people’s lives and personal relationships.
He has threatened to oppose the Supreme Court precedent set in Roe v. Wade, thereby preventing women from seeking adequate healthcare, forcing them to have dangerous and deadly back-alley abortions, and to punish women who have abortions and the doctors who perform them, granting Government the right to control women’s bodies and endanger women’s lives.
He has promised to defund Planned Parenthood, thereby denying access to reproductive healthcare for women and the disadvantaged.
He has promised to dismantle the Affordable Healthcare Act, thereby preventing access to adequate healthcare for millions of Americans.
He has threatened the safety of American citizens by inciting violence against them:
by encouraging violence at his rallies and implying that his political opponent, Hillary Clinton, should be assassinated;
by saying that sexual assault in the military is “totally expected”;
by admitting that he can sexually assault women “because he’s a star”;
by making crude, sexist comments about women and declaring a woman’s worth is defined by her body;
by mocking people with disabilities;
by declaring that Mexicans are murderers and rapists;
by blaming blacks and Hispanics for violent crimes across the country;
by getting rid of gun-free zones in the military and in schools;
by accepting the endorsement of the Ku Klux Klan;
by appointing a known white supremacist and misogynist as his closest advisor.
He has menaced our right to Free Speech by threatening to sue journalists—or anyone—who speak against him.
He has threatened to jail his political opponents.
He has threatened to allow the torture and waterboarding of enemy combatants, a strict violation of the Geneva Convention and the United Nations Convention Against Torture, which the United States ratified in 1994, and the violation of which will greatly endanger the lives and welfare of our own military personnel.
He has promised to terminate NAFTA—the North American Free Trade Agreement with Canada and Mexico—that economists say would “more likely cost U.S. jobs, millions of which depend on free trade . . .”
He has incited fear in the Muslim community by appointing to his transition team Frank Gaffney, an “anti-Muslim fear-monger,” named “one of America’s most notorious Islamophobes,” who wanted a House committee to “root out secret Muslim agents,” who accused Governor Chris Christie of treason when he appointed a Muslim judge, and who accused Obama of being a secret Muslim.
He has incited fear in minorities and women by installing Steve Bannon—a White Supremacist and anti-feminist—as the chief strategist of his administration, indicating a move toward an Alt-Right, fascist government; this appointment tacitly encourages discrimination, oppression, and violence against racial minorities, women, and the LGBTQ community.
He has gone against his campaign promise to “drain the swamp” by thwarting lobbyists and Wall Street bigwigs and to protect the interests of working families; that instead he has appointed these same insiders as advisors and cabinet members, breaking his biggest promise to his supporters. In a letter to Donald Trump, Senator Elizabeth Warren writes:
Within days of your election, you have elevated a slew of Wall Street bankers, industry insiders, and special interest lobbyists to your transition team. Even more are rumored to be named as potential cabinet members. . . . They include, among many others, a former Goldman Sachs executive who is rumored to be a Treasury Secretary pick; a paid consultant for Verizon who is making key decisions on your administration's Federal Communication Commission; a "top lobbyist" whose firm lobbied on behalf of issues related to the Trans-Pacific Partnership who is shaping your Labor Department; and a climate-change-denying, oil industry-paid think tank fellow who is leading your environmental team's transition.
He has encouraged a foreign nation to influence the outcome of our Presidential election. According to a senior Russian diplomat, “Russian government officials conferred with Trump’s campaign team” during the election, which Trump has denied. Yet on November 16, 2016, the National Security Agency determined that “Russia directly intervened in the US election to obtain a desired end: presumably to undermine confidence in US elections or to elect Donald Trump—or both.” The director of the National Security Agency, Admiral Michael Rogers, clearly accused “Vladimir Putin of meddling with American democracy.” Rogers said, "This was a conscious effort by a nation-state to attempt to achieve a specific effect. . . . This was not something that was done casually. This was not something that was done by chance. This was not a target that was selected purely arbitrarily."
He has committed fraud against the American people through lies and misdirection. As a function of his narcissistic personality disorder, pathological lying is Donald Trump’s go-to modus operandi—he cannot be trusted. This whirling dervish of fraud, deceit, and self-centeredness threatens the security of the United States of America, both at home and abroad. Our own political leaders, both Democrat and Republican, have warned of Trump’s incompetence. World leaders, shocked and dismayed by Trump’s election, are concerned about transatlantic relations. The New York Times was so concerned about a Trump presidency, they dedicated two full pages to list "The 282 People, Places, and Things Donald Trump Has Insulted on Twitter." Colombian cartoonist Vladimir Flórez spoke for the world when he said: “The excesses of this eccentric millionaire have proven that the number one enemy of the U.S. is not beyond its borders, but rather within. . . . This threat called Trump is a product of American society; a nightmarish mutation of the American dream.”
Trump’s rhetoric has legitimized hatred and bigotry, instilling terror in American citizens:
Once inspired and hopeful, now angry and fearful;
Once tolerant and compassionate, now fractious and fanatical;
Once inclusive and unified, now exclusive and extremist;
Once celebrating diversity, now advocating White Supremacy;
Once empowering women, now sanctioning sexual assault;
Once investing in Democratic secular ideals, now following Republican religious mandates;
Once looking to our Presidents as positive role models, now shielding our children from a President-elect who demoralizes us and shreds our values;
Once seeing our Presidents as a source of national pride, now humiliated that our President-elect brings us derision and shame.
A President’s duty is to uphold and protect the inalienable rights of American citizens, and to “preserve, protect, and defend the Constitution of the United States.” But Donald Trump has proven that he will not fulfill these obligations, that he will ignore both our Constitutional laws and the safety and happiness of Americans. A prince—a President-elect—whose character is thus marked by every act which may define a tyrant, is unfit to be the ruler of a free people.
We, therefore, the People of the United States of America, by the authority of the Popular Vote, do solemnly publish and declare, that President-elect Donald Trump is a clear and present danger to these United States; that the Electoral College has a duty to remove Donald Trump from the Office of the President; that his running mate Mike Pence should, therefore, also be removed; that all Trump appointees should be declared invalid; and that, as the winner of the popular vote, Hillary Clinton should be installed as the rightful President of these United States of America. Should the Electoral College fail in their duty and not honor the will of the people, as is demonstrated by the Popular Vote, We the People declare that we will not support Donald Trump as our elected President and that we have the right to Resist and Protest until our demands are met.
